Please read this CommunAbility e-Mentorship Program Terms of Use (“Program Terms of Use”) carefully before using the CommunAbility e-Mentorship Program (“Program”) provided by the Postsecondary Students with Disabilities Network Project or PSDNET, ("us", "we", "our" or “Project”) through our website, www.communability.ca (“Website”).
By accessing the Program, you (“User”, “Participant”) agree to comply with this Program Terms of Use, and the other agreements and policies posted on the Website, as amended from time to time. In the event of any inconsistency between the provisions of this Program Terms of Use of Use and any provision of the terms of the Website (the “Agreement”), the provisions of the Agreement shall prevail and govern.
Participation in the Program is voluntary and on an individual basis. To be eligible to participate in the Program as a mentee, a User must:
Be at least 18 years old,
Reside in Ontario,
Self-identify as having a disability, and
Currently attend an accredited post-secondary education program in Ontario
To be eligible to participate in the Program as a mentor, a User must:
Be at least 21 years old,
Reside in Ontario,
Self-identify as having a disability, and
Have previously attended an accredited post-secondary education program
By participating in the Program, a User must agree to be bound by this Program Terms of Use. If as a User, you do not agree to this Program Terms of Use, you cannot participate in the Program. If, for any reason, we believe that you have not complied with this Program Terms of Use, we may, at our discretion, cancel your access to the Program and the Website immediately and without notice.
As a Participant, you:
Expressly acknowledge and agree that you are participating voluntarily in the Program and that the Project is not responsible for your actions or the actions of other Participants.
Understand and agree that, unless otherwise agreed to by the Project, you are acting in your individual capacity and are not acting as a representative of, or on behalf of, an employer, professional society, educational institution, a sponsor, the Project, or anyone else.
Agree to complete the required application and training before beginning your first mentorship experience in the Program. You acknowledge that the Project may periodically require you to complete new training modules within a specific period of time to continue participation in the Program.
Represent that all information you enter in the Program application and submit to the Project is true or believed to be true. If you willfully enter any false information with deceptive intent, you acknowledge that the Project reserves the right to terminate your participation in the Program upon discovery of such false information. If you enter any false information through mistake, without any deceptive intent, you agree to correct such false information upon discovery of, or receipt of notification of, such false information. If any information that you have entered should change, you agree to timely update such information. If you do not timely correct such false information or update information that has changed, you acknowledge that the Project reserves the right to terminate your participation in the Program.
Confirm that you have read and understand the CommunAbility e-Mentorship Program Code of Conduct (“Code”). You agree to abide by the Code while you are participating in the Program. You acknowledge that the Project reserves the right to terminate your participation in the Program if you violate any of the terms of the Code.
Confirm that you have read and understand the Website Agreement. You agree to abide by its terms and conditions and acknowledge that if you violate any of the Agreement terms and conditions, the Project reserves the right to terminate your participation in the Program.
Confirm that you have read and understand the Privacy Policy of the Website. You agree to abide by its terms and acknowledge that if you violate any of the Privacy Policy, the Project reserves the right to terminate your participation in the Program.
Access to this Program is restricted. We reserve the right to prohibit access by any individual to this Program at the sole discretion of the Project. In order to gain access, you must meet the eligibility criteria and be approved by the Project. We allow you access to the restricted Program areas of the Website on the basis that:
You will not disclose your account username and password and take every reasonable measure to ensure that no unauthorized access or use of the Program is obtained through your username and password;
You will not do anything to assist anyone who is not a registered to gain access to any restricted area of the Website; and
You agree to be liable for all damages that arise from the unauthorized use under your account as a result of your carelessness with or disclosure of your account access information.
You agree to use this Program only in accordance with this Program Terms of Use, for lawful purposes and in a manner that does not infringe the rights of or inhibits its use by anyone else. In using this Program:
You agree that all communications and materials received from us and your mentor or mentee will remain confidential and shall not be made available to anyone else.
You accept responsibility for ensuring that no data is uploaded or submitted to the Website that is defamatory, obscene, abusive, or otherwise objectionable or in breach of any applicable laws or third party rights. We reserve the right to remove offending material that we consider constitutes misuse and/or that we consider is potentially harmful to others.
You agree to take all reasonable steps to ensure that any data submitted to the Website is free from viruses and anything else which may have a contaminating or destructive effect on any part of the Website.
You agree to make no attempt to damage, disrupt or undermine the integrity of the Program or any part of the Website. Further, you agree not to adapt or circumvent the systems in place in connection with this Program or any part of our Website nor access it other than through normal operations.
The Project reserves the right, at our sole discretion, to modify or replace this Program Terms of Use at any time. You are advised to review this Program Terms of Use periodically for any changes. Changes to this Program Terms of Use are effective when they are posted on this page. By continuing to access or use the Program after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please cease accessing and using the Program immediately.
